ESTABLISHMENT OF PRIVATE SCHOOL IN BASIC EDUCATION

Based from DepEd Order no. 88 series of 2010 (Revised Manual of Regulations for Private Schools in Basic Education), five (5) main programs namely pre-school education, elementary, secondary education, special needs education and alternative learning system should comprise the Basic Education Curriculum. Elementary education programs shall cover at least Grades I to VI; secondary education programs from First year to Fourth year or a total of ten (10) school years in the formal school system. It is reiterated that pre-school shall not be considered as prerequisite for enrollment for an incoming Grade one pupil.

As stipulated in the eight edition of the Manual of Regulations for Private Schools by Sarmiento, Article VII section 36 states that after September 11, 1982, established private schools must:

a). incorporate as non-stock educational corporation in accordance with the provisions of the Corporation Code of the Philippines and the Education Act of 1982, BP Blg. 232, although a stock educational corporation established before September 11, 1982, may opt to remain as such upon renewal of its corporate term; and

b). shall be owned solely by citizens of the Philippines or by corporations or associations at least sixty percent (60%) of the capital of which owned by such citizens, except those allowed to be established by religious groups and mission boards pursuant to the Constitution and special laws.

By virtue of the passage of RA 7798 all schools shall be established in accordance with the law. Any private school proposed to be established must incorporate as either a non-stock or a stock educational corporation in accordance with the provisions of the Corporation Code of the Philippines.
